I’m guessing he realizes what a mistake it was now.

Law enforcement officials have come to their own conclusion as to who was the instigator in the brawl that took place on Thanksgiving day between Gabriel Aubry and Olivier Martinez — according to them, it was Gabriel’s doing.

They believe that he committed two forms of battery before Martinez put such a supreme hurting on him.

Based on interviewing the principles and witnesses, detectives have concluded Gabriel then pushed Olivier (battery #1) and swung at his face, making contact with his shoulder (battery #2).

Cops say at that point, Olivier responded in self defense with 3 quick punches to the face.

However, it’s all for naught as all sides (Aubry, Martinez and Halle Berry) have decided not to press any charges following the incident, choosing to move forward. There could be some anger management classes for Aubry at an informal hearing at the L.A. city attorney’s office — but that may never come to pass, either as the hearing just might be dropped completely.

I think seeing his reflection in the mirror is punishment enough.

Bruises fade, but the memories… fade, too, I guess.

As it was originally predicted, Gabriel Aubry has decided to allow the restraining order against Halle Berry‘s fiance, Olivier Martinez drop, putting an end to the craziness which first began nearly two weeks ago.

Gabriel’s lawyer (and Lilo‘s, too) appeared in court on Friday morning with the request to drop the order to the judge overhearing the case.

Hours later, Gabriel got to do something he hasn’t in a while — spend some alone time with his daughter, Nahla. Another order was given against him following the fight.

Well, that was — not exciting at all.

UPDATE (7:10 pm; ET): And this came even before I posted this.

The settlement has been reached between the three of them.

Well, this came quickly.

In spite of the severity of the Turkey Day knockout round between Halle Berry‘s two main men — her baby daddy, Gabriel Aubry and current fiance, Olivier Martinez — it seems like it might be all water under the bridge soon.

Yesterday, attorneys for Halle and Gabriel were in family court to possibly work out the deals for a settlement (many people forget that all of this stems from a very ugly custody case, including Halle’s plea to move her 4-year-old daughter with Aubry to France).

With both of their lawyers acting so friendly (they showed up in tandem for the hearing), many believe that there might be peace between the three adults. Another sign: neither Halle nor Olivier showed up, which could possibly show that neither wishes to request that the current order of protection against Gabriel be extended past today’s end, who did appear.

Seems like this will all end soon — just tell that to Gabriel’s face.

Underneath the literal battle between the two main men in Halle Berry‘s life, Gabriel Aubry (her ex) and Olivier Martinez, there is one huge factor – her daughter Nahla… and Gabriel has just issued a huge power play in getting her back.

Aubry is headed to family court this morning in hopes of regaining visitation with his child, after being barred from having any contact with her following the brutal battle that left him nearly unrecognizable on Thanksgiving morning.

His lawyers will state that Olivier was the one who started the brawl and Halle’s lawyers (and possibly Halle herself) to oppose his argument.

If things weren’t ugly before, they sure are going to make Gabriel’s injuries look like a cakewalk after this.

At this point, everyone involved seems guilty — but might one be less guilty than first thought?

It was thought that Halle Berry would be the one to run to a judge early this week to make sure that crazed baby daddy, Gabriel Aubry stayed far away from her, daughter Nahla and current fiance, Olivier Martinez after last week’s Thanksgiving knockdown, drag out fight between the two men.

But in a surprising twist, Aubry was the one in a court room early Monday to ensure his safety from Halle’s new squeeze, who he claims was the one who started the fight the night before.

According to a declaration placed on behalf of the baby daddy by Shawn Holley, Gabriel’s attorney (yes, that’s LiLo’s attorney, too), Gabriel ran into Halle and Olivier the night before at a school play for his daughter. At some point, Olivier walked to Gabriel and whispered to him in French, ”I wish I could beat the s**t out of you right now. You’re lucky we’re in a school right now. We’re going to take Nahla right now and you’re not going to follow us.”

Obviously that didn’t occur as we know that Aubry was the one to bring his daughter back to Halle’s place the next day.

But we do know (at least from his angle) how the first punch was thrown — and from his version, the only monster involved is the Frenchmen laying in Ms. Berry’s bed.
